A Mandamus Denied
OLEOMARGARINE CASE GOES
TO THE SUPREME COURT.

Judge Kinne Monday morning denied the application of Eliott O. Grosvenor, state dairy and food commissioner for a mandamus to compel Justice Duffy to entertain a complaint against Caspar Rinsey, the well known grocer, for selling oleomargarine not of the color required by law.
Our readers will remember that this is the application spoken of in Saturday evening's paper and is made for the purpose of testing the constitutionality of the law, which has never been before the supreme court
There is no question of any intent to deceive on the part of Mr. Rinsey.
Mr. Grosvenor called for oleomargarine and got a pound package of it, duly labeled "oleomargarine," the only fault found with it was that it was "of the color of rich June butter."
Cavanaugh & Wedemeyer, the state's attorneys in the case will at once apply for a mandamus to the supreme court.
