Present, William D. Harriinnn, Judge of Probate, In the matter of the estáte of Rice A. Bea], deeeased. On reading and filiug the petitiou, duly verlfled, of Junius E. Beal Field, praying that a certain instrument now on file in this court purporting to be the last will and testament of eaid deceased, may be admitted to probate, and that he and Phebe B. Beal may be appoiuted executors thereof. Thereupon it is ordcred, that Monday, the fifth day of November next, at ten o'clock in the torenoon, be assigned for the hearing of said petition.and that the devisees, leñatees and heira at law of said deceased, and all other persone interested in eaid estáte, are reqnired to appear at a session of said conrt, then to be holden at the Probate Office, in the city of Ann Arbor, and show canse, if any there be, why the prajer of the petitioner should not be granted. Davis and Adelle E. Davis his wile dated Jauuary 16th, 1872, to Jared S. Laphïim which said mortgage was on the 27 th day of January, A.D. 1872, recorded in the offtce of the Register of Deeds for Waehtenaw County, Michigan, at ten o'clock in the forenoon of said day, in liber 44 of mortgages, on page 220. There is claimed to be dne on said mortgage at the date of this notice for principal and interest the sum of fonr tuousand and five hnudred dollars. No proceeding at law or in equity has been instituted to collect said mortgage debt or any portion thereof. Default has been made in the conditions ot said mortgage and the power of sale therein contained became operative.
